Motions for Deposit or Disbursement of Interpleader Funds Under 28 U.S.C. § 1335

PROCEDURES FOR DEPOSIT OR DISBURSEMENT OF INTERPLEADER FUNDS UNDER 28 U.S.C. § 1335
Beginning April 1, 2017, all attorney and pro se filers seeking leave of Court to deposit or disburse interpleader funds under 28 U.S.C. § 1335 must use one of the dedicated interpleader motions listed below.  For non-interpleader cases, the standard motions for deposit and disbursement of funds should be used.

MOTION for Interpleader Deposit (28 U.S.C. Section 1335): This motion should be used when the complainant/litigant has no ownership interest in the deposit (i.e., Motion to Deposit Funds or Motion for Order events should not be used).  This motion is located in CM/ECF under: Civil Events > Motions and Related Filings/ Motions > Interpleader Deposit (28 U.S.C. Section 1335)

MOTION for Interpleader Disbursement (28 U.S.C. Section 1335): This motion should be used for disbursement against interpleader funds deposited in the Court's registry (i.e., Motion for Disbursement of Funds or Motion for Order events should not be used).  This motion is located in CM/ECF under: Civil Events > Motions and Related Filings/Motions > Interpleader Disbursement (28 U.S.C. Section 1335)

IN ALL PROCEEDINGS INVOLVING DEPOSIT OR TRANSFER OF FUNDS TO THE COURT'S REGISTRY
In accordance with Administrative Order 16-MC-04-50, In the Matter of Deposit and Investment of Registry Funds (filed 10/20/2016), no money shall be deposited in the Court's registry without a court order signed by the presiding judge in the case or proceeding. The party making the deposit or transferring funds to the Court's registry are required to serve the order permitting the deposit or transfer on the Clerk of Court.  For additional information regarding registry deposits and disbursements, please refer to Administrative Order 16-MC-04-50, In the Matter of Deposit and Investment of Registry Funds (filed 10/20/2016), and D.N.M.LR-Civ. 67.
