CJA Frequently Asked Questions

  • Who will be transcribing the Hearing?

The attorney will need to check the docket and the Clerk's Minutes entry of the hearing to determine who the court reporter was, or if the hearing was recorded via tape recorder (Liberty or FTR Gold).

When an official court reporter was present at the hearing, they should be the individual transcribing the hearing. If there is no contact information available for that court reporter or they are no longer employed with the court, please contact Lincoln Sorrell at Ph (575) 528 1417 for guidance.

If the hearing to be transcribed is a digital audio recording from Liberty or FTR Gold, the attorney is responsible for selecting the transcriptionist. They must work directly with the transcriptionist, providing all necessary information required for transcription.

  • How do I request transcripts for something other than an official court proceeding?

Requests for the transcription of discovery related material, i.e. transcripts for anything other than court proceedings held in this court, should be done via a CJA21. Transcribers of this type of material should be treated as any other CJA21 service provider. Please note that transcriptionists hired under this scenario are not bound by the page rates established by the Judicial Conference of the United States. As with any other CJA21 service provider, transcriptionists cannot submit their own invoice in eVoucher. The attorney must submit it for them.

  • How will the court reporter or transcriptionist know when the AUTH24 is approved by the Court?

eVoucher does not automatically notify the court reporter or transcriptionist when an AUTH24 is approved by the Court. The Clerk's Office notifies staff and contract court reporters by email and/or by the creation of the CJA24, which occurs immediately after the AUTH24 is approved. While the Clerk's Office generally notifies transcriptionists by email when an AUTH24 is approved for a digital audio recorded hearing, it is the responsibility of the attorney to work with the court reporter or transcriptionist to ensure they have everything they need to complete the transcript. In this regard, it is also the responsibility of the attorney to notify the transcriptionist when the AUTH24 is approved. The transcript deadline is calculated from the date the judge approves the AUTH24, not the date the attorney initiates the AUTH24 request, so it is important that the transcriptionists be notified immediately once the AUTH24 is approved.

Please note: if you are requesting a transcript for an appeal, in addition to completing an AUTH24 you MUST complete a Transcript Order Form, file it with the District Court and the 10th Circuit Court of Appeals, and serve a copy on the court reporter or transcriptionist.

  • How do I request the accelerated production of a transcript?

Ordinary transcripts are produced within 30 days (60 days for civil cases on appeal). When completing the AUTH24, make sure you select the desired production deadline in the "Special Transcript Handling" field. Keep in mind that the quicker you request completion of the transcript, the higher the per page rate. While it is rare, the judge may not authorize the special transcript handling if the judge deems that accelerated production is not necessary. If nothing is selected in this field, the court reporter or transcriptionist will adhere to ordinary transcript production deadlines regardless of any communication you've had to the contrary. It is important to remember that you must request through eVoucher (as opposed to orally or informally through the court reporter) that you are seeking faster-than-ordinary completion of the transcript AND that the judge must approve such a request.

  • How do I delete or withdraw a transcript request submitted through eVoucher?

In order to withdraw a transcript request in eVoucher, the document must be rejected back through the workflow. For example, if an AUTH24 has been submitted, approved by the Clerk's Office and is now pending the judge's approval, you will need to contact chambers and request that the judge reject the AUTH24. Contact Financial Services if you need help identifying where the AUTH24 or CJA24 is in the chain of approvals.

  • When is it appropriate to order "Daily" rate transcripts, and at what point in the process should I do so?

Counsel can request "daily" rate transcripts at any point in the litigation. If you are planning to request daily transcripts for an upcoming hearing or trial please let the affected court reporter know verbally or via email, and begin an AUTH24 through eVoucher. These should be done as far in advance of the hearing/trial as possible.
